Participant Agreement
& Waiver

This agreement applies to all Hawaii Pickleball Academy® programs, including private lessons, group clinics, monthly clinics, after-school programs, tournaments, and any other activities organized by Hawaii Pickleball Academy®.

By registering for any Hawaii Pickleball Academy® program — including private lessons, group clinics, monthly clinics, after-school programs, tournaments, and all other activities — you acknowledge that you have read, understood, and agree to be bound by the terms of this Participant Agreement & Waiver. If you are registering a minor, you agree to these terms on behalf of yourself and your child.

01 Assumption of Risk

By registering for a Hawaii Pickleball Academy® program, you acknowledge that participation in physical activities such as pickleball involves inherent risks, including but not limited to physical injury, falls, collisions with equipment or other participants, and risks associated with outdoor or shared public facilities. These risks exist regardless of the venue.

You voluntarily accept and assume full responsibility for all risks associated with your participation (or your child's participation).

02 Liability Waiver

Hawaii Pickleball Academy®, its owners, instructors, coaches, staff, volunteers, and affiliates are not liable for any injuries, accidents, illness, or personal property loss that may occur during or in connection with any program session, regardless of location.

This waiver includes risks arising from the condition of the venue, weather, equipment, or the actions of other participants. This waiver does not apply to acts of gross negligence or willful misconduct by Hawaii Pickleball Academy® personnel.

03 Venue & Location

Hawaii Pickleball Academy® operates sessions at multiple locations throughout Hawaiʻi, including public parks, community centers, and private facilities. Session locations are communicated at the time of registration or in advance via email or program communications.

You acknowledge that venue conditions may vary by location and that Hawaii Pickleball Academy® does not own or control the facilities used. Risks specific to each venue — including uneven surfaces, weather exposure, public access, and shared use of facilities — are included in your assumption of risk.

04 Insurance Disclosure

Hawaii Pickleball Academy® maintains general liability insurance coverage for its programs and operations. This insurance is intended to protect the business and does not function as health, medical, or accident insurance for participants.

You are solely responsible for maintaining adequate health insurance coverage for yourself and any minors in your care. Hawaii Pickleball Academy® is not responsible for any medical, hospital, or related expenses incurred as a result of participation.

05 Medical Release & Health Disclosure

In the event of an emergency, you authorize Hawaii Pickleball Academy® staff to seek and obtain medical treatment for yourself or your child as deemed necessary. You agree to be financially responsible for any medical expenses incurred.

You must disclose at registration any known medical conditions, physical limitations, allergies, or medications that may affect the ability to safely participate. Failure to disclose relevant medical information releases Hawaii Pickleball Academy® from any additional liability related to that condition.

06 Supervision & Duty of Care

Hawaii Pickleball Academy®'s duty of care begins when a staff member checks in a participant at the start of a session and ends when the participant is released to an authorized adult at the conclusion of the session.

Hawaii Pickleball Academy® is not responsible for participants before check-in or after release, including during drop-off or pickup. Participants must not be left unattended at a venue without prior staff confirmation of the session start.

07 Dismissal, Pickup & Transportation

Participants will only be released to individuals listed on the authorized pickup list provided at registration. Hawaii Pickleball Academy® is not responsible for a participant who leaves with an unauthorized individual or who leaves the venue without authorization.

Hawaii Pickleball Academy® does not provide transportation between locations. Parents and guardians are solely responsible for all transportation to and from sessions. Late pickups beyond 15 minutes after the scheduled end of a session may incur a late fee. Please notify staff in advance of any changes to the authorized pickup list.

08 Code of Conduct

Participants are expected to behave respectfully toward instructors, staff, fellow participants, and members of the public at all venues. Bullying, unsafe behavior, use of inappropriate language, damage to venue property, or repeated failure to follow instructions will not be tolerated.

Hawaii Pickleball Academy® reserves the right to remove any participant from a program without refund if conduct standards are not met. Parents and guardians may also be asked to leave a venue if their conduct is disruptive or unsafe.

09 Health & Illness Policy

Participants who are ill, injured, or otherwise unfit to participate should not attend a session. Hawaii Pickleball Academy® reserves the right to send home any participant showing signs of illness or injury.

In the interest of all participants, please do not attend if you have had a fever, vomiting, or contagious illness within the previous 24 hours. Missed sessions due to illness are non-refundable — please contact us to discuss options.

10 Weather & Session Cancellations

Sessions held at outdoor venues are subject to cancellation or modification due to weather conditions including rain, lightning, extreme heat, or unsafe court conditions. Hawaii Pickleball Academy® will make every reasonable effort to notify registered participants of cancellations via email or text as early as possible.

Canceled sessions will be rescheduled where feasible. Refunds are not guaranteed for individual weather-related cancellations unless the full program cannot be completed.

11 Photo & Video Release

Photos and videos may be taken during program sessions at any location and may be used on social media platforms, websites, newsletters, and other promotional materials. By registering, you grant Hawaii Pickleball Academy® a non-exclusive, royalty-free license to use your image and likeness for these purposes.

If you do not consent to photo or video use, please notify us in writing prior to the start of the program. This release applies to all venues and sessions throughout the duration of enrollment.

12 Cancellation & Refund Policy

Cancellations made at least 7 days before the first session may be eligible for a refund, minus any applicable processing fees. No refunds will be issued after the first session has taken place. Missed sessions are non-refundable.

Hawaii Pickleball Academy® reserves the right to cancel or discontinue a program if minimum enrollment is not met. In that case, a full refund will be issued.

13 Payment Policy

A spot in any program is only secured once full payment is received. Spaces are limited and filled on a first-paid, first-served basis. Hawaii Pickleball Academy® reserves the right to cancel a registration if payment is not received by the stated deadline.

All fees are listed at the time of registration and are subject to change between program sessions.

14 Data Privacy

Information collected during registration is used solely to administer Hawaii Pickleball Academy® programs. We will not sell or share personal information with third parties except as required to operate the program or as required by law.

By registering, you consent to receiving program-related communications from Hawaii Pickleball Academy®. All participant data involving minors is handled in accordance with applicable federal and state privacy laws, including COPPA where applicable.

15 Independent Program — No School Affiliation

Hawaii Pickleball Academy® is an independent private program. It is not affiliated with, sponsored by, or acting as an agent of any school, school district, the Hawaiʻi Department of Education, or any other educational institution.

Enrollment in this program does not constitute enrollment in any school program, and no school-based protections, policies, or insurance coverage apply to participants in this independent program.

16 Governing Law & Severability

This agreement is governed by the laws of the State of Hawaiʻi. Any disputes arising from participation in the program shall be resolved in the courts of Honolulu County, Hawaiʻi.

If any provision of this agreement is found to be unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Digital Acceptance

By registering for any Hawaii Pickleball Academy® program — online, via email, or in person — you acknowledge that you have read, understood, and agree to this Participant Agreement & Waiver in its entirety. If registering a minor, you agree on behalf of yourself and your child.
