Disclaimer & Policies

1. Assumption of Risk

By registering your child for the Hawaii Pickleball Academy® after-school program, you acknowledge that participation in physical activities like pickleball involves inherent risks, including the potential for injury. You agree to assume full responsibility for your child’s participation.

2. Liability Waiver

Hawaii Pickleball Academy®, its instructors, staff, and affiliates are not liable for any injuries, accidents, or personal property loss that may occur during the program. Participation is at the participant’s own risk. This waiver does not extend to acts of gross negligence or willful misconduct by Hawaii Pickleball Academy® staff.

3. Medical Release

In the event of an emergency, you authorize Hawaii Pickleball Academy® staff to seek and obtain medical treatment for your child as deemed necessary. You agree to be responsible for any medical expenses incurred on behalf of your child.

4. Photo & Video Release

Photos or videos — including content shared on social media, websites, newsletters, and other promotional materials — may be taken during the program for promotional or marketing use. By registering, you grant Hawaii Pickleball Academy® a non-exclusive, royalty-free license to use your child’s image and likeness for these purposes unless you notify us in writing prior to the start of the program.

5. Cancellation & Refund Policy

Cancellations made at least 7 days before the first class may be eligible for a refund, minus any applicable processing fees. No refunds will be issued after the first class has taken place. Missed sessions are non-refundable.

6. Payment Policy

A spot in the program is only secured once full payment is received. Spaces are limited and filled on a first-paid, first-served basis. Hawaii Pickleball Academy® reserves the right to cancel a registration if payment is not received by the stated deadline.

7. Code of Conduct

Participants are expected to behave respectfully toward instructors, staff, and fellow participants at all times. Bullying, unsafe behavior, use of inappropriate language, or repeated failure to follow instructions will not be tolerated. Hawaii Pickleball Academy® reserves the right to remove any participant from the program without refund if conduct standards are not met.

8. Dismissal & Pickup Policy

Participants will only be released to individuals listed on the authorized pickup list provided at registration. Hawaii Pickleball Academy® is not responsible for participants who leave with an unauthorized individual or who leave the premises without authorization. Late pickups beyond 15 minutes after the scheduled end of the session may incur a late fee. Parents and guardians are responsible for notifying staff of any changes to the pickup list in advance.

9. Health & Illness Policy

Participants who are ill, injured, or otherwise unfit to participate should not attend the program. Hawaii Pickleball Academy® reserves the right to send home any participant showing signs of illness or injury. Parents and guardians must provide current emergency contact information at registration and disclose any known medical conditions, allergies, or physical limitations that may affect the participant’s ability to safely participate.

10. Data Privacy

Information collected during registration is used solely to administer the Hawaii Pickleball Academy® program. We will not sell or share personal information with third parties except as required to operate the program or as required by law. By registering, you consent to receiving program-related communications from Hawaii Pickleball Academy®. All participant data involving minors is handled in accordance with applicable federal and state privacy laws.

11. Program Changes & Cancellations

Hawaii Pickleball Academy® reserves the right to modify the program schedule, location, staffing, or content as necessary. In the event of a program cancellation due to weather, facility unavailability, or other unforeseen circumstances, every effort will be made to reschedule the session. Refunds are not guaranteed for individual canceled sessions unless the full program cannot be completed.

12. Governing Law

This agreement is governed by the laws of the State of Hawaii. Any disputes arising from participation in the program shall be resolved in the courts of Honolulu County, Hawaii. If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

We kindly ask for at least 24 hours’ notice for any cancellations or rescheduling. While late cancellations may be subject to a fee, we understand that life happens and always do our best to be flexible.
